New Video FAQ: How can I be found guilty of DUI if I wasn’t over the limit?

When a police officer pulls an individual over on suspicion of drunk driving, the officer may have that individual submit to a blood alcohol concentration (BAC) test. In Tennessee, if you’re pulled over and your BAC test result measures at .08% or higher, you can be arrested for DUI.

However, there are reasons the officer may decide to detain you if your BAC is lower than .08. While this is far less common, it happens.

Nashville criminal defense attorney Brent Horst has seen these kinds of cases in the past, and explains what is at play in them in a new video.
